Legal Update 2025

Legal Status in Pennsylvania

In December 2023, Pennsylvania's Commonwealth Court unanimously ruled that skill-based games are legal games of skill. The case is now before the Pennsylvania Supreme Court, which heard oral arguments on November 20, 2025. A decision is pending.

The court found that skill games differ from gambling because a skilled player can consistently win through pattern recognition and decision-making. While the Supreme Court reviews the case, skill games remain legal and operational throughout Pennsylvania, with approximately 80,000 machines currently in operation statewide.
